A nine-year-old boy has died after he was handcuffed and beaten by his mother’s boyfriend in punishment for eating cake without permission.
Jack Kirby Garcia was pronounced dead at Children’s National Medical Center in Washington, DC, on Sunday and had wounds on his neck, face, back, buttocks, abdomen and legs, according to Hagerstown police.
Robert Leroy Wilson, 30, the mother’s boyfriend, has since been charged with first and second-degree assault, child abuse and reckless endangerment for the incident which occurred on June 30. (Scroll down for the video.)
1. A nine-year-old boy died on Sunday after he was allegedly handcuffed and badly beaten by his mother’s boyfriend, Robert Leroy Wilson (pictured), for eating a piece of cake without permission.
The mother’s brother told the police that Jack was handcuffed on Tuesday in punishment for stealing a piece of the birthday cake. He added that Wilson struck the child in the stomach after the handcuffs were removed.
It is unknown whose cake it was, but the boy’s own birthday had been three days earlier, on June 27.
The incident took place at an apartment on Lynnehaven Drive in Hagerstown, Maryland, the local Police Department said.
Police were called to the home on Tuesday night and on arrival the officers found the child unconscious and not breathing. His body was covered with bruises, contusions and abrasions, according to Fox 5.

Police said in a statement:
Detectives learned the juvenile had been handcuffed and severely beaten by his mother’s boyfriend, Robert Leroy Wilson, earlier that day for eating a piece of birthday cake without his permission.
Detectives also learned the juvenile had been denied medical attention by his mother and Wilson for approximately four (4) hours despite another adult male, who was in the residence at the time of the assault, calling 911 for assistance.
When CRS arrived at the residence the first time, they were met outside by the juvenile’s mother who told paramedics that he was simply “congested” and not needed.
CRS would be called back to the residence at 10:37 pm [four hours later] after the juvenile stopped breathing.

Immediately following the incident, a prosecutor said that the child was not expected to regain consciousness and he later died.
Wilson is being held at the Washington County Detention Center on a $1 million bond. His preliminary hearing on the charges initially filed against him is scheduled for July 30, according to Herald Mail Media.
The charges against Wilson could be upgraded after the boy’s death, Fox 5 reports.
Police was to discuss with Washington County prosecutors the possibility of bringing additional charges in the case.
